    These Terms of Service ("Terms") govern your access to and use of the website www.nuberux.com (the "Website") and the purchase of any products offered on it, operated by Tiny Sprout ("Tiny Sprout", "we", "us", "our").

    By accessing the Website or placing an order, you confirm that you have read, understood and accepted these Terms. If you do not agree, please do not use the Website.

    The Website is operated by Tiny Sprout. You can contact us at any time at support.tinysprout@gmail.com. Where these Terms require notice to be given in writing, email to this address satisfies that requirement.

    2. ELIGIBILITY AND ACCEPTANCE
    By using the Website you confirm that you are at least 18 years old, or that you are using the Website under the supervision of a parent or legal guardian, and that you are legally able to enter into a binding contract. These Terms apply to every order and may be updated from time to time (see Section 17).

    3. ACCOUNT AND ACCURATE INFORMATION
    You may be able to create an account to place orders. You are responsible for keeping your login details confidential and for all activity under your account. You agree to provide accurate, current and complete information when ordering. We may refuse or cancel an order where the information provided is false, incomplete or cannot be verified.

    4. PRODUCTS AND AVAILABILITY
    We take care to describe and picture our products accurately. Minor variations in colour, appearance or measurements may occur, and product images are for illustration. All products are subject to availability, and we may change or discontinue a product at any time. Where a product is unavailable after you order, we will inform you and offer a replacement or a full refund.

    5. PRICES AND PAYMENT
    Prices are shown on the Website and may change at any time, but changes do not affect orders we have already accepted. Unless stated otherwise, prices exclude delivery charges, which are shown before you confirm your order. Depending on your delivery country, import duties or taxes may apply on arrival and are your responsibility.

    Payment is taken through our third-party payment providers at checkout. By submitting an order you confirm that the payment method used is yours or that you are authorised to use it. We reserve the right to verify payments and to cancel orders where payment cannot be authorised or fraud is suspected.

    6. ORDERS AND FORMATION OF CONTRACT
    Your order is an offer to buy. After ordering you will receive an acknowledgement email; this confirms we have received your order but does not by itself form a contract. A binding contract is formed only when we send an email confirming that your order has been dispatched. We may decline or cancel an order before dispatch — for example, if the product is unavailable, there is a pricing or description error, or we suspect fraud — and in that case we will refund any amount already paid.

    7. PRICING OR DESCRIPTION ERRORS
    Despite our care, products may occasionally be mispriced or misdescribed. If we discover an error in the price or description of a product you have ordered, we will contact you to ask whether you wish to continue at the correct price or cancel. If we cannot reach you, we may treat the order as cancelled and refund you in full.

    8. SHIPPING
    Shipping is governed by the Shipping Policy published on nuberux.com, which forms part of these Terms. Delivery timeframes shown on the Website are estimates and are not guaranteed.

    During periods of exceptionally high demand — such as Black Friday, Christmas, New Year, Mother's Day and other festive or promotional seasons — or in other extraordinary circumstances (carrier saturation, supply disruptions, adverse weather or similar events), delivery times may be extended to up to 30 business days from the purchase date. Where possible, we will notify you of the expected delay by email. If your order has not been delivered within this timeframe, please contact our customer service team, who will work with you to find the best possible solution.

    Tiny Sprout will not be liable for delays attributable to carriers, customs, periods of exceptionally high demand or events outside our reasonable control (force majeure). Risk in the product passes to you on delivery. Nothing in this section affects your statutory rights in respect of goods that are faulty or not as described.

    9. RETURNS AND WARRANTY
    Returns and warranties are governed by the Return, Warranty & Refund Policy published on nuberux.com, which forms part of these Terms. In summary, Tiny Sprout offers a voluntary 90-day guarantee applicable only in cases of:
    • Manufacturing defects
    • Products damaged on arrival
    • Delivery of an incorrect product or variant

    During periods of exceptionally high demand or other extraordinary circumstances, our response times and the processing of returns, refunds, replacements and reshipments may be extended, as described in that Policy. This never affects the statutory deadlines that apply to you.

    This voluntary guarantee is offered in addition to, and does not affect, the statutory consumer rights that apply in your country of residence (including, for UK and EU consumers, the right to cancel within 14 days and the legal guarantee for faulty goods).

    10. INTELLECTUAL PROPERTY
    All content on the Website (including texts, images, logos, graphics and design) is the property of Tiny Sprout or is used under licence. You may not reproduce, distribute, modify or otherwise use any content without our express written authorisation, except as permitted by law.

    11. PROHIBITED USES
    You must not use the Website:
    • For any unlawful or fraudulent purpose
    • In any way that may damage, overload or impair the operation of the Website
    • To attempt unauthorised access to any systems, accounts or data

    We may suspend or block access where these Terms are breached.

    12. LIMITATION OF LIABILITY
    To the fullest extent permitted by law, Tiny Sprout will not be liable for:
    • Indirect or consequential losses, or loss of profit
    • Financial losses arising from the use of the Website or products
    • Misuse of products by the customer

    Our maximum liability in any case is limited to the amount you actually paid for the relevant product. Nothing in these Terms excludes or limits our liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot be excluded under applicable law.

    13. DISCLAIMER OF WARRANTIES
    The Website and services are provided "as is" and subject to availability, without warranties beyond those required by law. We do not guarantee that the Website will be uninterrupted, error-free or free of harmful components, but we take reasonable steps to maintain it.

    14. EXTERNAL LINKS
    The Website may contain links to third-party sites. Tiny Sprout is not responsible for the content, policies or services of those third parties, and access to them is at your own risk.

    15. INDEMNIFICATION
    To the extent permitted by law, you agree to indemnify and hold Tiny Sprout harmless against any claim, damage or expense arising from your misuse of the Website, your breach of these Terms, or your violation of third-party rights.

    16. DATA PROTECTION
    The processing of your personal data is governed by our Privacy Policy, available on nuberux.com. By using the Website you acknowledge that your data is processed in accordance with that policy and applicable data protection law (including the UK GDPR and EU GDPR where relevant).

    17. CHANGES TO THESE TERMS
    We may modify these Terms at any time. The version published on the Website at the time you place an order is the version that applies to that order. We encourage you to review these Terms before each purchase.

    18. GOVERNING LAW AND DISPUTES
    These Terms are governed by the laws of Spain, without prejudice to the mandatory consumer protection rights of your country of residence, which continue to apply. EU consumers may use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr. UK consumers may be entitled to use an approved Alternative Dispute Resolution scheme.
